Refund Policy

    This Refund Policy ("Policy") sets out the terms governing refunds for services purchased from 360VentureStudios (hereinafter "Company", "we", "us", "our"), the parent company operating the brand Udyog360 (the "Platform"), accessible at udyog360.com and app.udyog360.com. This Policy forms an integral part of our Terms of Service.

    1. No Refund Policy

    🚫 All payments are final and non-refundable.

    We do not issue refunds under any circumstances whatsoever.

    By making a payment and using our Services, you acknowledge and agree that:

    • All sales are final and binding.
    • No refunds, whether full or partial, will be issued for any reason.
    • This no-refund policy applies to all Services without exception.

    2. Rationale

    Our no-refund policy is based on the following considerations:

    2.1 Nature of Services

    • Our Services involve the commencement of work immediately or shortly after payment, including document preparation, form drafting, government fee payments, and coordination with Government Authorities and Professional Partners.
    • Once work has commenced, significant time, effort, and resources (including third-party costs) are invested which cannot be reversed or recovered.
    • Government fees paid on your behalf to MCA, GST Network, or other authorities are non-refundable by the respective government bodies and cannot be recovered by us.

    2.2 Third-Party Costs

    Our service delivery involves engagement of:

    • Chartered Accountants (CAs) and Company Secretaries (CSs) for professional services
    • Digital Signature Certificate (DSC) providers
    • Government filing portals and their associated fees
    • Stamp duty and registration charges (varies by state)
    • Name reservation fees, DIN fees, and other statutory charges

    These costs are incurred immediately upon service initiation and are non-recoverable.

    2.3 User Responsibility for Documents

    ⚠️ The User is solely and entirely responsible for furnishing valid, genuine, complete, and accurate KYC documents and information required for any service.

    • If a government application is rejected, delayed, or denied because the User provided invalid, incomplete, expired, inconsistent, tampered, or fraudulent documents — no refund will be issued.
    • If a company incorporation, GST registration, or any compliance filing fails because the User failed to provide required documents within the specified timelines — no refund will be issued.
    • If the User's DSC is expired, revoked, or invalid, causing filing failures — no refund will be issued.
    • If the User provides mismatched information across documents (e.g., name on PAN differs from name on Aadhaar) causing rejection — no refund will be issued.
    • If the User fails to respond to our requests for additional documents, clarifications, or corrections within the timelines communicated — no refund will be issued.

    3. Specific Scenarios – No Refund

    Without limiting the generality of the above, no refund shall be issued in the following specific scenarios:

    3.1 Company Registration

    • Name rejection by ROC — names are subject to ROC's discretion; we do not guarantee name availability or approval
    • DIN application rejection due to incorrect personal details provided by the User
    • Rejection of incorporation application due to deficient documents
    • User changes mind after initiating the registration process
    • Delay in government processing beyond our control

    3.2 GST Registration and Filing

    • GST registration application rejected due to invalid address proof, unverifiable principal place of business, or Aadhaar authentication failure
    • Show Cause Notice (SCN) issued by the GST officer — we can assist but the outcome is not guaranteed
    • Late filing penalties arising from the User's delay in providing invoices, sales data, or purchase records
    • Incorrect GSTIN details provided by the User leading to filing errors

    3.3 Income Tax Returns

    • Delay in filing due to the User's failure to provide Form 16, Form 26AS, AIS, bank statements, or other required documents in a timely manner
    • Tax demand raised by the Income Tax Department based on information provided by the User
    • Incorrect computation arising from incomplete or inaccurate financial information provided by the User

    3.4 Annual Compliance and ROC Filings

    • Additional government fees or penalties for delayed filing due to the User's failure to provide necessary information or approve draft documents on time
    • Rejection of forms by MCA due to incorrect information furnished by the User

    3.5 Other Registrations (MSME, IEC, FSSAI, Trademark, etc.)

    • Application rejection by the respective government authority for reasons attributable to the User
    • Trademark objection or opposition by third parties
    • Duplicate registrations or applications already filed by the User independently

    3.6 General Scenarios

    • User decides not to proceed after payment has been made
    • User's business plans change
    • User finds a cheaper alternative
    • User is dissatisfied with government processing timelines (which are beyond our control)
    • Platform downtime or maintenance (we will ensure service completion once restored)
    • Changes in government rules, regulations, or fees after purchase

    4. Service Credits (Discretionary)

    While we do not offer refunds, in exceptional circumstances and entirely at our sole discretion, we may offer service credits that can be used towards future services on the Platform. This is not a right and the User cannot claim or demand service credits. Factors we may consider include:

    • Whether the service could not be initiated at all due to reasons solely attributable to the Company
    • Duration and nature of the issue
    • The User's history and engagement with the Platform

    Any service credits issued shall be valid for a period of 6 months from the date of issuance and are non-transferable, non-encashable, and cannot be converted to cash.

    5. Chargebacks and Payment Disputes

    ⚠️ Filing a chargeback without contacting us first is a violation of these Terms.

    In the event of a fraudulent or unjustified chargeback, we reserve the right to:

    • Suspend or terminate your account immediately
    • Cease all pending services
    • Report the matter to appropriate authorities
    • Pursue legal remedies for recovery of amounts, including legal costs
    • Report to credit bureaus and fraud prevention agencies

    6. Government Fee Refunds

    Government fees (MCA fees, GST registration fees, stamp duty, DIN fees, name reservation fees, etc.) are paid directly to the respective Government Authorities. These fees are governed by the refund policies of the respective authorities, not by Udyog360. We have no control over government fee refunds and cannot process them. If you believe you are entitled to a refund of government fees, you must approach the respective Government Authority directly.

    7. Cancellation

    • You may request cancellation of a service by emailing support@udyog360.com.
    • Cancellation does not entitle you to any refund.
    • If work has already commenced, you remain liable for all costs incurred up to the point of cancellation.
    • Government fees already paid cannot be recovered through cancellation.

    8. Consumer Protection

    This Policy is in compliance with the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020. Our no-refund policy is clearly communicated to you before purchase. By proceeding with payment, you acknowledge that you have read, understood, and agreed to this Policy.

    10. Governing Law and Jurisdiction

    This Refund Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts located in Gurgaon, Haryana, India.

    11. Amendments

    We reserve the right to modify this Refund Policy at any time. Changes will be effective upon posting on the Platform with an updated "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the revised Policy.
